Paul Burton and Michael Corrigan examine the recent decision to not declare the shipping channel service at the Port of Newcastle, which they say is a timely reminder that Part IIIA of the Competition and Consumer Act is not of itself a panacea to curb the pricing conduct of infrastructure service providers, even monopolists.
